Driver’s license suspension is a potential part of any Chicago DUI case. When you are arrested for DUI, the officer will confiscate your Illinois driver’s license and will give you a notice that your license is going to be suspended on the 46th day following the arrest. You may face this suspension (called a Statutory Summary Suspension) if you refuse to submit to chemical testing, such as a breath or blood test, after you have been arrested for DUI. You may also face suspension if you take a breath test or blood test and your result is above the legal limit (.08% or greater), or if your blood or urine contain any amount of an illegal or intoxicating substance.
You have the right to challenge your license suspension. You may also have the right to seek a Monitoring Device Driving Permit or MDDP, which is a restricted license which will enable you to drive for purposes of work, education and medical needs.
